1. Overview

 

This E-Commerce Policy governs your purchase, use, and interactions with DS4MD’s website and services. It applies to all online orders, digital transactions, and related customer relationships.

 

By placing an order on DS4MD, you agree to abide by this policy, our Terms of Service, our Privacy Policy, and other site policies.

 

2. Orders, Pricing & Payment

    •    Order Acceptance & Confirmation

Receipt of your order does not guarantee acceptance. Once payment is confirmed, and the order is reviewed for accuracy and inventory availability, DS4MD will send you an order confirmation.

    •    Pricing & Fees

All prices are listed in U.S. dollars. Sales tax will be applied as required by applicable law and displayed at checkout. Shipping and handling fees are additional unless otherwise stated.

    •    Payment Methods

DS4MD accepts payment via credit/debit cards, digital wallets, or other methods displayed at checkout. Payment must be made in full before production begins.

    •    Fraud & Verification

We reserve the right to verify credit card or payment information. If verification fails or additional information is required, we may cancel or delay the order and contact you.

 

3. Order Changes & Cancellation

    •    Once an order enters production (printing, personalization, or special order processing), changes or cancellations may be limited or impossible due to custom work.

    •    If you request cancellation before production begins, we will attempt to cancel and refund your order (minus any non-refundable costs).

    •    If cancellation is permitted after production begins, a restocking fee or cancellation charge may apply, at DS4MD’s discretion.

 

4. Shipping & Delivery

    •    Processing Time

See our Processing Times & Production Schedule policy for estimates based on order type (sublimation, personalization, special orders, bulk, preorders).

    •    Transit / Shipping Time

Shipping times (carrier transit) are separate from processing time and will vary based on shipping method and destination.

    •    Partial Shipments

We may ship portions of your order when ready. You’ll be notified of each shipment.

    •    Risk of Loss

Once the package is turned over to the shipping carrier, the risk of loss or damage passes to you. Please inspect upon receipt and report issues promptly.

    •    International Shipping

For orders outside the U.S., you are responsible for import duties, customs fees, or taxes imposed by your country. DS4MD is not liable for delays due to customs.

 

5. Returns, Exchanges & Refunds

    •    Eligibility

Because many of our products are personalized or custom-printed, returns or exchanges are accepted only for defects, misprints, or damage during shipping.

    •    Notification Period

You must notify us in writing (with photo evidence) of any issue within 14 days of delivery.

    •    Inspection & Approval

DS4MD will inspect any returned item and, if approved, either repair, replace, or refund (in whole or in part) the item; shipping costs for returns may be borne by the customer unless the error is ours.

    •    Non-returnable items

Custom or personalized items (e.g. with your image) generally may not be returned for reasons of buyer’s remorse or change of mind.

 

6. Intellectual Property & Product Use

    •    All DS4MD site content (designs, logos, images, text) is owned or licensed by DS4MD and is protected by copyright, trademark, or other intellectual property laws.

    •    Purchasing a product gives you a license to use that product personally; it does not transfer ownership of DS4MD’s designs or grant rights to reproduce or resell the design.

    •    You represent that any images or artwork you submit do not infringe any third-party rights (copyright, trademark, likeness) and you hold all necessary permissions and consents.

 

7. Customer Data, Privacy & Montana Law

 

7.1 Privacy & Data Practices

    •    Our Privacy Policy describes how we collect, use, store, secure, and share your personal data. We limit collection to what is necessary for order processing, marketing (if you opt in), and service delivery.

    •    We implement reasonable security measures to safeguard your personal information.

    •    We only share data with third parties (e.g. fulfillment, payment processors) as needed to fulfill your order, and such third parties must comply with appropriate confidentiality and security obligations.

 

7.2 Montana Consumer Data Privacy Act (MCDPA)

    •    Under the revised MCDPA (as amended by SB 297, effective October 1, 2025), Montana consumers have expanded rights over their personal data.  

    •    Consumer Rights

You may request to:

    1.    Confirm whether DS4MD is processing your personal data and access the data (unless revealing a trade secret).  

    2.    Correct inaccuracies in your personal data.  

    3.    Delete your personal data, subject to legal or contractual retention obligations.  

    4.    Obtain a portable copy of personal data you provided, in a reasonably usable format.  

    5.    Opt out of:

    •    Targeted advertising using your personal data

    •    Sale of your personal data

    •    Profiling in furtherance of automated decisions with legal or similar effect  

    •    DS4MD will offer a secure, easy method for you to exercise these rights (e.g. via email or account dashboard).

    •    We will respond to consumer requests within 45 days, with a possible extension of up to 45 more days for complex requests, provided we notify you of the extension.  

    •    We will inform consumers of material changes to privacy practices or this policy and provide a reasonable opportunity to withdraw consent for new uses.  

    •    For minors’ data, there are heightened protections: even if DS4MD might not otherwise be subject to the MCDPA under thresholds, the minor-specific provisions apply universally.  

    •    The 60-day cure period against enforcement is removed after October 1, 2025 — violations may be enforceable immediately.  

 

8. Disclaimers, Limitation of Liability & Indemnification

    •    DS4MD strives to maintain accuracy of product descriptions, imagery, and pricing, but inadvertent errors may occur. We reserve the right to correct errors and cancel orders.

    •    To the maximum extent allowed by law, DS4MD is not liable for indirect, incidental, punitive, or consequential damages arising from your purchase, use, or inability to use products.

    •    You agree to indemnify, defend, and hold DS4MD harmless from claims, losses, liabilities, or expenses (including legal fees) arising from your breach of this policy, misuse of products, infringement or violation of rights, or failure to obtain necessary permissions or consents.

 

9. Dispute Resolution & Governing Law

    •    These terms are governed by the laws of the State of Montana, excluding its conflict-of-law principles.

    •    Any dispute arising under or in connection with this policy or a transaction must first be addressed informally; if unresolved, you and DS4MD agree to submit to binding arbitration or a court in a Montana forum (as may be specified in separate Terms of Service).

 

10. Changes & Updates

    •    We reserve the right to revise this E-Commerce Policy at any time.

    •    When changes are material, we will notify users (e.g. via email or banner) and provide access to the previous version.

    •    Your continued use of DS4MD’s services after the effective date of changes constitutes your acceptance.
